Conditions of taking part in prize draws

General provisions

### Article 1

(1) The organiser of the prize draw is Sitik d. o. o., Cistercian Abbey of Stična, Stična 17, 1295 Ivančna Gorica (hereinafter: the organiser).

(2) Where a business partner of the organiser also takes part as co-organiser of the prize draw, that partner provides the prizes and carries out the draw, while the organiser runs the prize draw on its own web pages, in the online shop and/or on Facebook profiles, Instagram profiles and the like, as laid down in the text announcing the individual prize draw.

(3) Where the prizes are provided by a business partner of the organiser who does not wish to take part in the role and obligations of a co-organiser, all these activities are taken over by the organiser.

Conditions of taking part

### Article 2

(1) Persons of full age with permanent or temporary residence in the Republic of Slovenia may take part in a prize draw. Minors (under 18 years of age) must have the prior written consent of a parent or legal representative in order to take part.

(2) Registered users of the online shop may enter a prize draw, unless the text announcing the prize draw provides otherwise. A visitor registers in the online shop by entering their valid email address as their user name during registration, by which they confirm their identity. Signing up to and using the website and the online shop is free of charge. Where a prize draw runs through the Facebook social network, all persons who within that network are associated with the particular profile on which the prize draw is running may take part, that is all persons who have clicked the Like button on that profile, unless the text announcing the prize draw provides otherwise.

(3) Taking part in a prize draw is not conditional on a purchase, and Sitik d. o. o., Cistercian Abbey of Stična makes no charge for it.

(4) Participants bear all the costs of taking part in the prize draw themselves.

The costs of taking part include, among others:

  • the cost of access to the internet;
  • the cost of transferring data from the internet.

(5) Employees and external contractors of Sitik d. o. o., Cistercian Abbey of Stična, and their immediate family members, may not take part in a prize draw.

(6) Each individual may enter a given prize draw only once.

The course of the prize draw

### Article 3

A detailed presentation of the prize draw and of how it runs is available on the website, in the online shop and/or on the Facebook profile and the organiser's other profiles on social networks.

Rules of the prize draw

### Article 4

(1) The starting and closing dates of the prize draw are published on the website, in the online shop and/or on the Facebook profile or other profile where the prize draw is running.

(2) By taking part in a prize draw, a participant is taken to accept these general conditions of taking part and the conditions published on the website and/or the Facebook or other profile of the organiser.

(3) Where incomplete, incorrect or untrue details are given (the email address or the details under Article 8(3) of these general conditions), the organiser reserves the right to refuse the participant's taking part in the prize draw or to exclude them from it.

A participant loses the right to a prize if the organiser establishes that:

  • the participant did not meet the conditions of taking part;
  • the participant has broken the rules and conditions of taking part in the prize draw;
  • the participant does not wish to meet the obligations under these conditions or under the particular conditions published on the website and/or the Facebook or other profile, or has not met them in good time;
  • in the case of entries: where the entry is in any way unsuitable.

Where a participant loses the right to a prize, the organiser decides whether or not to award the prize to somebody else.

(4) Where the conditions of the prize draw make taking part conditional on the participant submitting sketches, drawings, photographs, video recordings or other copyright material, the participant, by passing the material to the organiser, warrants that they hold all the economic copyright entitlements in that material and transfers them in full, once and for all and for all cases, to the organiser of the prize draw.

(5) By passing on the material under the previous paragraph of this article, the participant gives irrevocable consent to its publication, exhibition, printing, distribution and the like, in part or in whole, without limitation as to transformation or processing of the material, in all media (printed media, on websites, Facebook profiles, advertising editions or other media) of the organiser or co-organiser of the prize draw, without the right to compensation or payment. At the same time the participant waives the right to review, approve or object to any manner of use of the material, to the editorial choice or to the appearance of the material.

(6) Where a participant is drawn or chosen as a winner, by accepting the prize they give irrevocable consent to co-operating with the organiser or co-organiser in the sense of being photographed for the purposes of advertising and of publishing the material so obtained in all media (printed media, on websites, Facebook profiles, Instagram profiles, advertising editions or other media) of the organiser or co-organiser of the prize draw, without the right to compensation or payment. At the same time the participant waives the right to review, approve or object to any manner of use of the material, to the editorial choice or to the appearance of the material.

Prizes

### Article 5

(1) An individual participant may receive only one of the prizes. If a participant is drawn twice or more, they receive the prize for which they were drawn first.

(2) The kind and description of the prizes are set out in the text announcing the prize draw on the website and/or the Facebook profile and the organiser's other profiles on social networks where the prize draw is running.

(3) Prizes may not be exchanged for another kind of prize, paid out in cash or transferred to third parties.

The drawing of prizes

### Article 6

(1) The organisation, running and supervision of the prize draw and the drawing of the winners are looked after by a committee made up of representatives of the organiser and/or representatives of the co-organiser.

(2) The drawing of prizes takes place on the day set out in the description of the prize draw on the website and/or the Facebook profile or other profile of the organiser, and at the latest within 14 days of the close of the prize draw, at the registered office of the organiser (Sitik d.o.o., Cistercian Abbey of Stična) or of the co-organiser.

Notifying the winners

### Article 7

(1) A winner will receive notice of the prize by private message on their Facebook or other profile, in a comment, or at the email address they gave at the start of the prize draw on the website.

(2) By taking part in a given prize draw, a participant agrees that, if drawn, the organiser may publish them as a winner on the wall of the Facebook profile and tag them there. Where a prize draw runs only on the website, the participant agrees that, if drawn, the organiser may publish them as a winner on the website where the prize draw is running.

(3) The list of winners will be published on the website and/or the Facebook profile within three days of the drawing of prizes at the latest. Where the drawing is carried out by a co-organiser, the list will be published within ten days of the day of the drawing at the latest.

(4) The results of a prize draw are final. There is no appeal against them.

Collecting prizes

### Article 8

(1) A participant is entitled as a winner to collect the prize if the organiser or the administrator of the website and/or the Facebook or other profile notifies them of the prize within the agreed time.

(2) Prizes are taxed under the Personal Income Tax Act. The winner is liable to pay income tax in accordance with the Personal Income Tax Act (other receipts, among which prizes also fall). The advance payment of income tax is calculated and paid over by the organiser of the prize draw, or by the co-organiser or the sponsor who provides the prize.

(3) To collect a prize, the winner must, on the written call of the organiser, supply the following personal data: name and surname, the exact address of permanent residence, place of residence, tax number and tax office. For the purposes of notice about collecting the prize, the winner also gives a contact telephone number. If the winner does not supply the necessary data within seven days of the date the call was sent, they lose the right to the prize without any right to compensation.

(4) By the written call under paragraph (3) of this article, the organiser informs the winner of the way the prize is to be collected. The organiser may send the prize at its own cost to the address the winner has given, and the prize may also be collected in person at the Father Simon Ašič Herbal Pharmacy, Stična 21, 1295 Ivančna Gorica. Where the prize is a delicate article (for instance delicate packaging or contents, glass packaging, packaging containing liquid and the like) or an article which by its weight and/or size is not suitable for safe sending by post, winners collect the prize in person at the registered office of the organiser. By agreement with the winner, delicate articles may also be sent by post, but the organiser accepts no liability for any damage arising while the parcel is being sent. Where a parcel is lost or damaged and/or its contents are damaged, the winner is not entitled to any compensation, financial or material.

(5) Persons under 18 years of age must, in order to collect a prize, supply the organiser with the written consent of a parent or legal guardian at the same time as the data under paragraph 3 of this article, and at the latest by the time the prize is collected.

Protection of information and personal data

### Article 9

(1) The organiser Sitik d. o. o., Cistercian Abbey of Stična, as the controller of personal data, respects the privacy of participants in a given prize draw and undertakes to treat the personal data obtained during the prize draw carefully, to protect them and to process them in accordance with the Personal Data Protection Act and the rules on the protection of personal data adopted by the organiser.

(2) Without the express consent of participants in a given prize draw, the organiser will not pass participants' personal data to third parties or use them for purposes other than solely for the needs of the successful running of the prize draw as a whole, unless the rules provide otherwise.

(3) Where the organiser runs a prize draw together with a co-organiser, it will pass the list of winners to that co-organiser. The organiser accepts no liability for the proper processing and keeping of data passed to a co-organiser.

(4) Where a participant in a prize draw agrees to their data being passed to a co-organiser, the organiser will pass all the data of such users to the co-organiser after the draw has ended. The organiser accepts no liability for the proper processing and keeping of data passed to a co-organiser.

(5) Where a participant in a prize draw agrees to receive the newsletter of the organiser and/or the co-organiser, the organiser may also pass the email addresses to the co-organiser of the prize draw.

(6) The organiser accepts no liability for the protection of data on websites to which certain links on the organiser's websites lead, nor does it accept liability for any errors that may arise where participants in a prize draw supply incorrect or false data.

(7) A participant in a prize draw permits the organiser, as the controller of the collection of personal data, to keep, maintain and process the collection of personal data supplied for the needs of running the prize draw, in accordance with the Personal Data Protection Act, until the participant withdraws that permission or the purpose of processing has been fulfilled. The personal data in the collection of winners' personal data, and the purpose of their collection, processing, storage and use, are:

  • the email address (for the needs of taking part in the prize draw, of the drawing, and of sending the organiser's written calls regarding further steps where there is an entitlement to a prize);
  • name and surname, address and place of residence (for the needs of identifying the winner, of the drawing, of notice about prizes and about the way prizes are collected, and for the needs of reporting to the tax authorities in accordance with the tax legislation in force in the Republic of Slovenia);
  • a contact telephone or mobile number (for the needs of notice in the event of any difficulty with the delivery of a prize);
  • the winner's tax number and tax office (for the needs of reporting to the tax authorities in accordance with the tax legislation in force in the Republic of Slovenia).

(8) While the personal data are being managed, every individual participant has the possibility of inspecting, transcribing, copying, supplementing, correcting, blocking and erasing the personal data in the collection of personal data, in accordance with the rules in force.

(9) The organiser keeps the data in computer form. Once there is no longer a need to keep the data, or at the request of a winner, the data are erased.

(10) The users of the data may also be the administrator of the website and/or the Facebook profile and those responsible for delivering the prizes.

(11) By taking part in a prize draw, a participant agrees that the organiser may send them free general notices connected with the prize draw by email or to the telephone number under Article 8(3) of these conditions, until that consent is withdrawn or the purpose of keeping the contact details has been fulfilled.

Final and transitional provisions

### Article 10

(1) Participants in a prize draw on a Facebook profile accept, together with the conditions of the prize draw, also the conditions and rules of the Facebook community. The organiser accepts no liability for participants' failure to observe the conditions of use of the Facebook community. Nor does it accept liability for any consequences arising as a result of the publication of contributions on Facebook or a similar profile on other social networks.

(2) The organiser reserves the right to supplement and change the conditions of a prize draw where reasons of a technical or commercial nature, or reasons on the part of the public, require it.

(3) The organiser will keep participants informed of all changes and news about a prize draw by publishing them on the website and/or the Facebook profile or other profile where the prize draw is running.

(4) Questions about the confidentiality and use of your personal data, or a wish for further information about a prize draw, should be addressed to the email address: info@sitik.si.
