The General Terms and Conditions of service and use of the website www.pater-simon-asic.si (hereinafter: on-line store, Sitik d.o.o., supplier) have been prepared in accordance with the Consumer Protection Act and other acts governing internet sales and such method of operation. The General Terms and Conditions govern the use of the on-line store and the business relationship between Sitik d. o. o., registered users (hereinafter: users) and buyers of products or services (hereinafter: buyers).

1. General
The on-line store is intended for selling food products, food supplements, herbal preparations and similar products which are produced, imported and marketed by Sitik d.o.o. Click here for more information about the supplier and the on-line store.

2. Information availability
The supplier undertakes to always provide the buyer with the following information:
– company identity (company name and seat, registration number),
– contact data to enable faster and more efficient communication (e-mail, telephone),
– the essential properties of products or services (including after-sales services),
– product availability (each product or service offered on the website should be available within a reasonable period of time),
– product delivery or service execution conditions (delivery method, place and deadline),
– prices of products that must be clearly and unambiguously determined and which must show whether taxes and transportation costs are already included, and payment and delivery methods,
– an explanation of complaint procedure, including full data about the contact person or customer service.

3. Products and origin
The product mix in the on-line store may change daily due to the nature of operations. All prices stated in the on-line store are final, unless otherwise stated. Sitik d.o.o. is a taxable entity, hence all prices are subject to VAT. The prices are valid at the moment of order submission and do not have a predetermined validity. The prices apply in the case of payment using the indicated payment methods and under the conditions which are stated in our on-line store at the moment when the order is submitted.
Despite the supplier’s efforts to provide up-to-date and accurate data about product prices in the on-line store, it may happen that certain price information is incorrect. In this case or in the case the price of a product changes while an order is being processed, the supplier will enable the buyer to withdraw from the purchase and offer the buyer a solution which will be to the mutual benefit of both parties.
The prices of products do not contain the cost of delivery or shipping. The price of delivery or shipping depends on the weight of the ordered products and is shown in the cart before order confirmation.
The sales contract between the supplier and buyer is concluded at the moment when the supplier confirms the order and the buyer receives an e-mail with the status “Order confirmed”. From that moment onwards, all prices and other conditions are fixed and apply to both the supplier and the buyer.

Special offers
Discounts are non-cumulative, unless otherwise stated in the terms and conditions of special offers. Only one promotional code can be used for one purchase. Unless otherwise agreed or determined, free shipping or delivery does not apply to the purchase of products which are on special offers. Similarly, promotional codes cannot be used to further reduce the prices of products or the final price of the already discounted products in the cart.

Photographs, images and graphics
Photographs, images or recordings published in the context of the promotions are owned by Sitik d.o.o. or its suppliers and business partners. Photographs, images or recording may be symbolic and do not provide accurate properties of a product or service, but they may show a symbolic or actual service, offer, company, products or sales campaign. Although the supplier tries to ensure accurate photographs of the products sold, all photographs should be taken as symbolic. Photographs do not guarantee product properties.

Opinion about products and the supplier
The supplier is not responsible for the content of opinions about products and services written by visitors and users. The supplier may review opinions prior to publication and reject those that contain apparent falsehood or are misleading or offensive. The supplier is not responsible for the information in opinions, or any content therein.

4. On-line store purchase procedure and invoice
Sitik d.o.o. is a company that offers products or services via the internet and in a physical shop (address of the physical shop: Čajnica in zeliščna lekarna patra Simona Ašiča, Stična 17, 1295 Ivančna Gorica).
The buyer pays the purchase price to Sitik d.o.o., and receives an invoice together with the products. The on-line store operates on the territory of the Republic of Slovenia and in other EU countries. Shipped packages contain printed invoices.

Purchase statuses
Buyers can always access information on the status and content of their orders on the supplier’s website. The order processing phases and conditions are provided in the continuation.

Order received:
After submitting the order, the buyer receives an e-mail confirming that the order has been received. Within an hour from the submitted order, that is, when the order processing phase starts, the buyer has the right to cancel the order and withdraw from the contract remotely (the order must be cancelled by e-mail to info@sitik.si). The order number must be provided. The e-mail address that the buyer uses to cancel the order must be the same as the e-mail address used to confirm the purchase. If the buyer does not cancel the order, the order will go into the processing phase.

Order confirmed:
If the buyer does not cancel the order within an hour after submission, the order goes into further processing where the supplier reviews the order, checks the availability of the ordered products and confirms the order or rejects it by providing the reason. To check the data and ensure a timely delivery, the supplier may contact the buyer to the buyer’s contact telephone number or via e-mail. Upon order confirmation, the supplier also notifies the buyer about the expected delivery date. The contract of the purchase of the ordered items between the buyer and the supplier is irrevocably concluded at this point.

Order shipped:
The supplier prepares the products within the agreed period, ships them and notifies thereof the buyer via e-mail.

Return of products
The buyer may agree on the return of products with the supplier by notifying their intent via e-mail to info@sitik.si.
Products may be returned within 14 days after acceptance. The products sold in the on-line store may be returned, if they do not belong into the following groups of products:
– groups of products that are sealed and consequently not appropriate for return for health or hygienic reasons, if the consumer has opened the seal after delivery (e.g. sealed food products),
– groups of products with a required storage regime in a certain temperature range where the buyer cannot ensure an appropriate temperature regime or is not authorised for measuring temperature with a calibrated instrument, which is why the products are unsuitable for return (e.g. chocolates, ointments, etc.).
The returned products must be packed in a closed original packaging; the quantity of the products must be the same as when received, and they must be undamaged. The buyer bears the costs of product return. 
Any dispute arising herefrom and any other potential disputes shall be settled before the competent court in Ljubljana.

Purchase abuse and unilateral withdrawal from the contract
If the buyer does not accept the ordered products which were sent with the selected payment method “cash on delivery” and does not withdraw from the contract in writing in due time, resulting in the products being returned to Sitik d.o.o. after the end of the 15-day period, this does not mean that the contract has been terminated since it is still validly concluded; this means that the buyer has unilaterally and without announcement withdrawn from the contract. In case of non-acceptance of the ordered products, the buyer shall be responsible for the payment of damages for which the supplier will issue a payment note with the information for the payment which the buyer is obliged to settle due to not having cancelled the contract and order via e-mail to info@sitik.si (or other valid methods pursuant to ZVPot). If the sent payment note is not paid, the matter shall be regulated by ordinary litigation procedure.
The approximate amount that is charged to the buyer in case the non-accepted products are returned to us is EUR 12.00 including VAT. This amount can also be higher, if a package is heavier and/or a higher shipping cost is paid for it. 

Secure purchase
When users register on pater-simon-asic.si, their personal and other data are collected pursuant to the Personal data protection act and individual’s personal consent. Sitik d.o.o. undertakes to carefully and safely keep such data for the purpose of smooth order execution or for personalised offer preparation, statistical analysis and for the purpose of improving the functioning of the on-line store and services. The newsletter includes exclusive offers for the registered users only.

5. Registration procedure
Users can place orders in the on-line store as guests or as registered users. The registration procedure is simple and fast. By registering to the website, each user can create their own account via which they can edit their data and the delivery address, check order status, track orders and edit them.
The username is the e-mail address entered by the user. The user receives a confirmation mail to that e-mail address to complete registration. By registering in the on-line store, the user also has a better overview of purchases.

6. Communication
The supplier will contact users via on-line communication means only if users do not expressly reject this.
Electronic advertisements contain the following:
– a clear and unambiguous marking of the advertisement,
– a clearly visible sender,
– various special offers, promotions and other marketing techniques will be clearly marked as such and the conditions of participation will also be clearly defined,
– a clearly presented method to unsubscribe from advertisements which will be strictly observed by the supplier.

Users may subscribe to receiving newsletters and also easily unsubscribe. Notifications include information about current or future offers, promotion and other advertisements. Notifications can be received subject to prior personal consent; they cannot be received if the user does not mark this when registering or subscribing in another way.

7. Disclaimer
The supplier makes every effort to ensure that the data published on its websites are up-to-date and correct. Nevertheless, the characteristics of products, delivery periods or prices of products may change so quickly that the supplier is unable to update the data on its websites in due time. In such cases, the supplier will notify the buyer of changes and enable the buyer to withdraw from the order or to change the ordered product.
The supplier is not responsible for the content of opinions about products and services written by visitors. The supplier may review opinions prior to publication and reject those that contain apparent falsehood or are misleading or offensive. The supplier is not responsible for the information in opinions, or any content therein.
Although the supplier tries to ensure accurate photographs of the products sold, all photographs should be taken as symbolic. Photographs do not guarantee product properties.

8. Buyer’s rights
On-line store purchases are considered to be made based on a distance contract. The language in which a contract is concluded is Slovenian.
Pursuant to Article 43.c of the Consumer Protection Act, the buyer, in the case of distance contracts, has the right to notify the supplier about contract withdrawal within fourteen (14) days. It is considered that the notice is timely and effective if the shipment with the returned products is submitted within the deadline and in accordance with Article 4 of these General Terms and Conditions (Product return). The only cost chargeable to the consumer in relation to contract withdrawal is the direct cost of product return. If the consumer withdraws from the contract and returns the products in due time, the supplier will make a refund for all payments made as soon as possible, but not later than within 14 days from receiving the contract withdrawal notice or from receiving the returned products.
If upon the supplier’s notice the buyer does not settle the purchase price or make the advance payment based on the issued pro forma invoice as contract conclusion guarantee, it shall be considered that the buyer did not accept the offer and that the contract has not been concluded. The supplier shall immediately notify the buyer thereof.

The buyer shall communicate with the supplier regarding the exercising of their rights via e-mail to info@sitik.si.

9. Discounts and discount codes
If the supplier prepares special offers with discounted prices or discount codes for customers, the special offers and discounts are mutually exclusive, unless otherwise stated in the on-line store.

If a customer returns a product purchased at a discounted price, the purchase price is refunded subject to the abovementioned conditions. When the same product is re-ordered, the price of the product is such as provided in the on-line store at that moment and the discount codes that are valid at that moment can be applied.
